In case you missed it, Attorney General Blumenthal ("super
Blumenthal", to you) and his staff ATTORNEYS have recently completed
what I'm SURE was an exhaustive investigation of the IDSA Guidelines
process.

If anything appeared in the course of that investigation that would
have indicated that there was probable cause to think a crime might
have been committed, they would have been duty-bound to pursue that.

Look...they have even begun to figure it out over at LymeNUT.

Ms. Smith bet the farm for you and rolled snake eyes.

This was a fishing expedition...only problem is...no fish.

Now...the settlement precludes any further action in Connecticut based
upon any claimed deficiencies in the Guideline process.

But the reality...is that it probably puts an end to any possibility
of an open-ended investigation of Lyme research-related allegations,
period...given the outcome here.

Just a dumb question:
Would Attorney General Blumenthal & his group be considered the
plaintiff and the IDSA the defense then each of the two sides findings
are presented or if you want to call it evidence in ref to
Blumenthal's side - now the question is : Is it the JUDGE who looks
everthing over and then the judge would be the one who makes the
final decision if quilty or not quilty in ref. to the IDSA having
financial interest involved in these quidelines------------------------

All that this does is open it all up to criminal charges later, when
it is found by a panel that IDSA (it's actually the ALDF,com and
Kaiser) defrauded the United States.
The basis of it all was the change in the testing for Lyme at
Dearborn.

This is a SETTLEMENT AGREEMENT.

NOTHING is going to appear before a Court.

IF Blumenthal had decided to take this to Court (on what grounds, I
cannot imagine)...then He would have had to present his "findings" to
a Judge and have the judge rule on them.

But this did NOT happen...and without the IDSA then, admitting them,
his "findings" have NO legal meaning WHATEVER.

Despite all the talk of glorious victory from the LDA. It's NOT a
"ruling"..,it 's NOT a "finding"..,it means ZERO.

But basically, YES, if the thing HAD in fact, proceeded to a
hearing...then it would be a JUDGE who would make the
determination...NOT Blumenthal.

Not too much science there to be honest. So Lyme can trigger and auto-
immune condition, that is not news for me, neither for the IDSA. I
agree they haven't taken that issue with the seriousness it demands. I
don't doubt there could've been conflict of interests to some degree,
but what institution doesn't have them?. Robert Gallo the guy that co-
discovered HIV is probably billionaire from the patent he holds on the
test alone, these tests have never been validated through blood
cultures of the virus.

If you see the settlement as a victory, well...
