Archuleta's Dad Banished from "Idol"

TMZ has learned David Archuleta's dad, Jeff, has been officially
banned from "American Idol."

Here's how it went down. "Idol" sources tell TMZ Jeff has been a
complete pain in the ass, interfering with the entire production. He
has badgered producers, the band, vocal coaches and even other
contestants. The final straw came this week, when Jeff wanted to
change the lyrics to David's first song, "Stand By Me." Jeff insisted
on adding a verse from Sean Kingston's hit, "Beautiful Girls."
Producers sent him an e-mail telling him the lyrics could not be
changed. They were beyond pissed when David sang the song with
Kingston's lyrics during the live show.

We're told by changing the lyrics, it created problems with the song's
publisher and cost "A.I." a lot of money.

Jeff was ordered to sit with "A.I." lawyers on Wednesday, who told him
he was "banned from being in the rooms where David was learning or
rehearsing his songs." It's "Idol's" position, since David is 17, he
does not need a guardian -- just a teacher. Jeff will be allowed to
sit in the audience during the live show but he's 86'd from anything
backstage.

Sources say the other contestants were fed up with Jeff and didn't
want him near them. Now they have their wish.

All in all, sources say Jeff is the stage dad from hell. BTW, he was
banned on the set when David did "Star Search" a few years back.

Yeah, absolutely. In the Byzantine web of rights to music, an artist has an
absolute right to perform and record any song listed by a public rights
distribution agency but cannot change the words.

Now they will need, ex post facto (as we lawyers say), to negotiate a
specific and much higher performance fee directly with the publishing
company. And AI will have to take their offer or face litigation over
damages for infringement, PLUS they could be unable to sell the tune on
iTunes.

Jeff could misbehave all he wanted, apparently, until he committed the
capital sin -- interfering with AI's income stream.

Well, thank heaven for the recording industry. It gives lawyers and
journalists someone to look down on, ethically.

What?

There are loads of examples of artists changing words to songs when they
cover them. Are you saying they were all illegal? Did the Association get
sued for correcting the grammar in the Mamas and Papas song "Go Where You
Wanna Go"?

In this particular case, there are many examples on YouTube of Stand By Me
and Beautiful Girls juxtaposed by artists, like Jabberwock, which is likely
where Archie got the inspiration, and where the conflict might arise. He
only used two words, "beautiful girls", but also the tune from one phrase
of the Kingston song.

The problem seems to be not that he changed the lyrics in the song they
paid for, but that he stole the new lyrics from a different song they
had NOT paid for. That would be expensive.

Two words aren't lyrics, but with the accompanying phrase, it makes
somewhat of a link.

Exactly. And it's about respect. Violent stage father Jeff Archuleta
wanted to do a fatass Sean Kingston's version of it and the A.I.
producers said, no; you do it like originally written and recorded.
Jeff, thinking he can make his own rules, made poor David do it w/ the
added lyrics. The cause was anger from the producers (and copyright
infraction). I think they should have penalized *DAVID* for it, even
though father was behind it. What will happen if/when David wins
runner-up.... will Jeff make his own rules and declare that season's
results invalid and say his son won and is the 7th season A.I.

No matter how upset they are with Jeff Achuleta, it's nothing compared
to how upset David A's fans would be if AI bounced him from the
competition for it.

the minefield of rights management in the music industry.

Hmm, on second thought, did the AI producers tell him specifically not to do
it? I'm guessing they did, since they have a dress rehearsal the afternoon
of the show. Maybe he should get tossed.

He's 17 and getting closer to 18. Yeah, he pulled a switcheroo during
the live show. Tossed, perhaps that's going a bit too far (?). But
some kind of punishment is in order for purposely disregarding the
rules. Even if his father hadn't said he wanted it different and he
sang out of the blue to the surprise of AI and the world, he still
needs a strike against him because he's not following the rules. Some
kind of punishment sets precedence. Punishing him sends a message to
future-contestants that "you better not try this". It'd actually be a
world of chaos if other contestants could bend the rules. Going beyond
the minute and a half time limit... starting all over again because
you messed up the intro (which a different contestant did). We don't
need rebels. We need robotic conformity from our A.I. contestants,
because that's what they signed up for when they auditioned for the
show.

There's A LOT of stupid rules on American Idol. Having these old
crooners 40 years older than the contestants (who the fuck needs a
Dolly Parton or a Neil Diamond as a coach?, let alone singing their
dippy songs on a theme night??????) is dumb. But it's the hoops you
gotta jump through to snag the crown.

I way disagree about that. I'm sure that if you made it 100% optional,
every singer on the show would beg to have half an hour of instruction, and
suggestions about their next performance, from Dolly Parton or Neil Diamond.
I don't even like Neil Diamond and if I were a singer -- much less a
contestant about to sing a song he wrote -- I'd really give a lot for a
session with him.

They are both extremely successful songwriters as well as top professional
performers. Most people are mature enough, especially if they are trying to
start out in a profession, to realize that top successful people in their
field might actually know something they don't.

I don't understand this.

How is "And all you beautiful girls, oh, stand by me" a link between the two
songs, especially when the kid is standing on a stage with a pit of
"beautiful" girls in front of him?

Unoriginal rip-off artist Sean Kingston's song "Beautiful Girls" was
recorded because he got permission to use the SBM riff. When you do it
Sean's way, you're violating his copyright. David's dad had the idea
that would sound best. AI producers nixed the idea. He went through
with it anyway. A copyright violation was formed.

I think David's Dad has a really poor instinct for what sounds best
(which is why, naturally, he wants to be a music producer).

What was that horrible Up With People song he did awhile back that he
swore was one of his favorite songs but clearly meant it was one of
his Dad' s favorites...?
