Boring.CHATTANOOGA, Tenn. (AP) -- A federal judge has thrown out a lawsuit
challenging Tennessee's indoor smoking ban and a hike in the state's
cigarette tax.
U.S. District Judge Curtis L. Collier in Chattanooga found Monday that
there was no basis for the lawsuit against Gov. Phil Bredesen and the
Tennessee General Assembly.
The state last year increased the cigarette tax on each pack of
cigarettes from 20 cents to 62 cents and banned smoking in most indoor
public places.
Plaintiff James Burnette called the new laws a conspiracy to try to
reduce smoking rates. But Collier found that to be a legitimate aim
for a state government and that smokers are not unfairly targeted by
the laws.
