This is going to sound strange...

....but I think the FIA is being consistent. McClaren was found guilty of
possessing Ferrari's data, but they weren't punished until the FIA
determined that they'd actually used the information. Now, the FIA
determined that Renault has possession of McClaren's data, but doesn't
have evidence that it was used.

The FIA never determined that McLaren had used the data. They just
said that they had this feeling in their water that the data had been
used in some unspecified undefined fashion for sone unspecified
undefined purpose. There is no consistency. The FIA is bereft of any
credibility it might once have had.

Might is definitely the operative word here.

Bring back Jean Marie Balestre...

Have you actually read the FIA report? Renault engineers went through the
data (or some of it) with a fine toothcomb and even asked for clarification
on the legality of one of the concepts. Despite this they initially denied
it had ever been shown to anyone there except Mackereth who brought it to
them. They only stopped lying about it after an independent investigation
proved that 9 people had used it and I think we can safely bet there were
more than that if the truth be told.

The FIA only has to look at its own records to see that Renault DID use the
data - they actually presented a McLaren drawing which was illegally in
their posession to the FIA as evidence in their protest against the 'J'
damper. Case founded - Renault used the data. Fine should be the same as
McLaren's.

Thank God Mosely doesn't actually practise law any longer. He's an idiot.

That's the problem. He does... practice. I doubt he's going to get any
better.
